Terms of Use

WAAMS is run by the State of Western Australia through the Department of Training and Workforce Development. By accessing or using WAAMS, you agree to these Terms of Use and any other terms, conditions, policies or notices that apply to WAAMS services.

Scope of these Terms of Use

These Terms of Use explain the rules for accessing and using WAAMS.

They cover:

  • access, registration and account security;
  • information accuracy, privacy and confidentiality;
  • transactions, notifications and audit records;
  • acceptable use and system availability; and
  • legal responsibilities, limitations and governing law.

These Terms are issued by the State of Western Australia acting through the Department of Training and Workforce Development (Department).

These Terms must be read with the Department’s applicable Privacy, Disclaimer and Copyright policies, Collection Notices, and any additional terms that apply to a service or program accessed through WAAMS.

By applying to access, accessing or using the Portal, you agree to be bound by these Terms of Use. If you do not agree, you must not access or use the Portal.

Definitions

Department, we, us or our: the State of Western Australia acting through the Department of Training and Workforce Development.

you or your: the individual accessing or using the Portal and, where applicable, the Organisation or person on whose behalf the individual is acting.

Authorised User: a person authorised to access and use the Portal.

Organisation: an employer, registered training organisation, Apprentice Connect Australia Provider, group training organisation, business, government entity or other body that accesses or uses the Portal.

Material: any information, document, content, record or data submitted, uploaded, entered, viewed, accessed, generated, received, processed or maintained through the Portal.

Portal or WAAMS: the Western Australian Apprenticeship Management System, including the Online Client Portal and any related online functions, services or modules made available by the Department.

Access and registration

To gain access to the Portal, an Organisation User or Individual User must complete the WAAMS registration process and any identity, eligibility or authority verification required by the Department.

WAAMS assigns levels of access to different categories of user. Your access may be limited to the information, functions and transactions appropriate to your role and authority.

You are responsible for your own compatible hardware, software, device, browser and internet connection, including any related costs. The Department does not provide technical support for your hardware, peripheral devices or third-party software.

To help protect the security of the Portal and user accounts, the Department may require users to authenticate using Multi-Factor Authentication (MFA) or other security measures. Users must comply with any authentication requirements specified by the Department and are responsible for maintaining the security of their authentication credentials, devices and verification methods.

The Department may change the technical requirements for accessing the Portal.

Account and portal security

You are responsible for keeping your login details secure and for taking reasonable steps to prevent unauthorised access to your Profile and the Portal.

You must not:

  • disclose or share your password or other login details;
  • allow another person to access the Portal using your Profile;
  • access the Portal using another person’s Profile or login details;
  • leave a device unlocked and unattended while logged in to the Portal; or
  • attempt to bypass multi-factor authentication or another security control.

You must log out when you finish using the Portal, particularly when using a shared or publicly accessible device.

You must notify the Department immediately if you know or reasonably suspect that your login details have been disclosed, your account has been misused, or a security incident has affected Portal information.

The Department may treat transactions or instructions submitted through your account as submitted by you. This does not apply if the Department has been told, or is otherwise aware, that the account or login details may have been compromised.

Organisation users and authority to act

Organisational users with the portal administrator role can create or modify access for users within the Organisation. The organisation administrator is responsible for managing users and keeping their authority and access current. 

This includes ensuring that:

  • access is provided only to persons authorised by the Organisation;
  • each user is given only the level of access required for their role;
  • authorisations remain current and have not been revoked; and
  • access is promptly disabled when a user ceases to represent, work for or require access on behalf of the Organisation.

Transactions and records

You accept full responsibility for all information, documents, declarations, applications and transactions submitted through your account, including transactions submitted by persons authorised by you to access or use the Portal on your behalf.

All transactions submitted through the Portal are deemed to occur in Western Australia and are recorded using Perth, Western Australia local time.

Transactions submitted through an Authorised User account are treated as valid instructions. If information is submitted in error, you must notify the Department as soon as possible.

The Department may retain audit records of Portal access, submissions and transactions, which may be used as evidence of Portal activity where permitted by law.

Electronic communications

You agree to receive communications electronically through the Portal, email, SMS or another electronic channel used by the Department for WAAMS services.

Contact details provided during training contract sign-up may be used to deliver notifications and communications. WAAMS allows users to update their contact details at any time, and you are responsible for keeping them current and accurate.

The WAAMS Noticeboard is the primary communication and notification channel for training contract matters unless the Department specifies otherwise. You must regularly check notifications and keep your contact details current.

A notification or communication takes effect when it is electronically issued by the Department, unless the notification, communication or applicable law specifies another time.

To the extent permitted by law, the Department and its officers and employees are not liable for loss arising from a failure or delay in delivering an electronic notification.

Acceptable use

You must use the Portal only for lawful purposes, within the access granted to you, and in accordance with these Terms of Use.

You must not:

  • access, view, copy, change or disclose Material that you are not authorised to access;
  • bypass, undermine or interfere with security, authentication or access controls;
  • disrupt, damage, reverse engineer, scrape, harvest or systematically extract content, systems or underlying technology;
  • use WAAMS for unauthorised commercial exploitation or to build or inform an unrelated product or service;
  • impersonate another person, Organisation or authorised representative;
  • remove Material unless it is your own Material and WAAMS permits removal;
  • infringe intellectual property, privacy or other rights; or
  • encourage, facilitate or undertake unlawful, misleading, malicious, defamatory or fraudulent conduct.

A failure to comply with this section may result in access being restricted, suspended or terminated and may be referred for investigation or other action.

Portal availability

The Department will take reasonable steps to minimise interruptions but does not guarantee that the Portal will always be available, uninterrupted, secure or error-free.

The Department may undertake maintenance that makes all or part of the Portal unavailable. Where practicable, planned maintenance or significant outages may be notified through the WAAMS Noticeboard or another Department channel.

If you cannot access the Portal, you are responsible for contacting the Department by another available method where action is time-critical.

Intellectual property

The Department or its licensors own or hold rights to intellectual property in the Portal, including its software, functionality, design, branding, content and related materials, unless stated otherwise.

Access to the Portal does not transfer ownership of intellectual property. You may use the Portal and Department Material only for the purposes for which access is provided and as permitted by law or the Department’s Copyright policy.

You must not reproduce, modify, distribute, publish, commercially exploit or create derivative works from the Portal or Department Material without prior written permission, except where permitted by law.

Disclaimers and liability

The Portal is provided on an “as is” and “as available” basis. To the extent permitted by law, the Department does not warrant that the Portal will be continuously available, error-free, fit for a particular purpose, defect-free, or free from third-party interruptions.

The Department is not responsible for the operation, availability or security of third-party technologies, networks, devices, software or websites used in connection with the Portal.

To the extent permitted by law, the Department is not liable for loss, damage, cost or expense arising from use, inability to use, delay, error or unauthorised use of WAAMS. This includes data loss or corruption, business interruption and loss of opportunity.

You are responsible for, and indemnify the Department against, loss or damage to any person arising from:

  • your breach of these Terms of Use;
  • Material submitted or disclosed by you without authority; or
  • a wilful, negligent or unlawful act or omission by you in connection with the Portal.

Your liability is reduced to the extent that a wilful, negligent or unlawful act or omission of the Department contributed to the loss or damage. Your responsibility for actions undertaken through the Portal continues after your access ends.

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.

Changes to these Terms of Use

The Department may review and update these Terms of Use at any time. The current version will be published through the Portal, the Portal noticeboard or another Department website identified for that purpose.

Removal of access

The Department reserves the right to immediately suspend or terminate access to the Portal at its discretion for any reason at any time. These Terms and Conditions will survive any such termination

Governing law

These Terms of Use and the use of the WAAMS online client portal are governed by, and construed in accordance with, the laws of the State of Western Australia
